Article 1. About us
These sales conditions apply to the e-commerce website eclobeauty.com operated by the company Sustainable Beauty with a share capital of €10,953.80, registered office at 107, Avenue Henri Fréville, Cs 10704, 35207 Rennes Cedex 2, and registered with the RCS of Rennes under number 899 132 203 (hereinafter, the "Seller"), which sells products to consumers and buyers (hereinafter, the "Client").
By using this site, you acknowledge that you have read and accepted these conditions.

Article 2. Purpose
These sales conditions aim to define the contractual relationships between Sustainable Beauty and the Buyer and the conditions applicable to any purchase made through the website eclobeauty.com.
The purchase of a product through this site implies an unconditional acceptance by the Buyer of these sales conditions, which the buyer acknowledges having read prior to placing the order.
Before any transaction, the Buyer declares, on the one hand, that the purchase of products on the site eclobeauty.com is not directly related to his professional activity and is limited to strictly personal use, and on the other hand, that he has the full legal capacity, allowing him to commit to these general terms of sale.
Sustainable Beauty retains the right to modify these sales conditions at any time to comply with new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.
Definitions:
- "User" means any legal or natural person who uses this Site.
- "Buyer or Buyers" means the Consumer who placed an order for a Product sold on the Internet Site;
- "Order" means any order placed by the User on this Site and registered for this purpose on it;
- "General Terms and Conditions of Sale or GTC" means these general terms and conditions of online sale;
- "Products" means material things that can be appropriated and offered for sale on this Site;
- "Site" means this website, namely eclobeauty.com;
- "Company" means the company Sustainable Beauty, more fully described in Article 1 hereof.
Article 3. Products
The Products offered are those listed on the Site, subject to availability. The Company reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description including its main technical characteristics (capacity, use, composition). Photographs are as accurate as possible but do not bind the Seller in any way. The sale of products presented on the eclobeauty.com Site is intended for all Buyers residing in countries that fully allow the entry of these products into their territory.
The buyer declares to have perfect knowledge of the product provisions and agrees not to hold the seller responsible, subject to the application of mandatory legal provisions.
Article 4. Prices and VAT
The prices of the products are those listed on the site on the day of consultation by the client. The prices of the products are indicated in euros and include VAT, excluding delivery costs, which remain the responsibility of the customer unless otherwise stated or under particular conditions. European Union countries are taxed at the current VAT rate. Other countries are exempt and pay entry duties. The tax calculation is fully automated by the system.
Customs fees:
Your order will be shipped from our logistics provider in France.
For European Union member countries, no customs fees will be applied.
Outside of these countries, customs fees may be applied by the customs of the delivery country. The amount may vary depending on the country in question.
Article 5. Ordering Process
The User places his order by following the six steps below:
Step 1. Create your customer account, enter your username and associated password, or
Step 2. Add the selected Product(s) to your cart. Access to the cart is possible at any time for modification or validation.
Step 3. Validate your cart after checking its content.
Step 4. Access your account to confirm and complete the necessary delivery details. In case the customer does not already have an account on the Site, create his customer account and fill in the required information regarding his identity.
Step 5. On the order summary page, expressly accept the general terms and conditions of sale of the Site.
Step 6. Finally, the customer will be redirected to the secure online payment site to validate the payment. The final acceptance by the customer is materialized by the validation of his bank details (credit card number, expiration date, and cryptogram). The placing of an order by the customer implies the full and unconditional adherence of the latter to these general conditions of sale.
Order confirmation:
When your order is transmitted, you will receive a confirmation email including the registration of your order, the details of the ordered items, personal data including the address and delivery method. No cash on delivery or payment by money order.
Order tracking:
To track the progress of your order, go to "My account" in the online catalog. After logging in, you can check the status of your orders.
"Not processed": your order is still being prepared.
"Processed": your order is ready to be collected by our carriers. You will soon receive an email from the carrier informing you that it has been collected.
Order archiving:
The customer's cart is archived and kept for a subsequent order for a period of 30 days, even in the event of an interruption of the internet connection. Order details are archived in accordance with Article L.134-2 of the Consumer Code, for a period of ten years on a secure server. However, no credit card number is retained. The customer accepts that the order confirmation be considered as proof of the contractual relationships between the Parties.
Article 6. Secure Payment
Sustainable Beauty has implemented a secure payment system for any order placed on the e-shop eclobeauty.com.
The customer can pay for his order using various payment methods:
By credit card: Visa, Master Card, CB. All credit card numbers are encrypted on 128 bits by the software when the order is placed. Orders delivered outside Metropolitan France are exclusively payable by credit card. Secure payment.
By PayPal: Your payments are made directly on the PayPal site via encrypted pages using the SSL protocol (Secure Socket Layer). eclobeauty.com does not have access to your banking details in any way.
Article 7. Delivery Time and Shipping Costs
We currently delivery to the following countries : France, Belgium, Germany, Luxembourg, Netherlands, Spain, Portugal, Italy, Austria, Ireland, Poland, Andorra, Monaco.
The Client will be informed by email of the taking charge of the package with the parcel tracking number. Shipping costs are automatically calculated at the end of your order depending on the place of delivery.

Delivery times do not include preparation times, which can result in a few days' difference in receiving your order.
Furthermore, delivery times are the sole responsibility of the carriers, and under no circumstances can the responsibility of Sustainable Beauty be engaged in the event of non-compliance with delivery times.
Article 8. Retention of Title
Sustainable Beauty retains full ownership of the products sold until the full collection of the price, including principal, fees, and taxes.
Article 9. Delivery Anomaly
Upon receiving the order, the customer must verify the conformity and condition of the products and, if necessary, issue all relevant reservations regarding apparent defects (missing product, damaged package).
The responsibility for the merchandise lies with the customer. The customer must refuse a package with anomalies or a presentation that suggests partial or total deterioration or theft. In the event of a return by La Poste due to a refusal of reception for package damage, the order is resent to the customer without charge and in good condition.
The customer must report any errors, anomalies, or defects concerning the received items by email or any other written means within 48 hours of receiving the package. Contact us through our contact form, specifying your claim subject with your Internet order number.
In the case of a returned package to the sender due to non-claim at the post office or relay point within 15 days, you will be refunded the amount of your order minus 10€. The refunded amount represents the initial amount of your order minus the order management fee, which is 10€.
Article 10. Right of Withdrawal
In accordance with Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for a refund without penalty, excluding return costs.
To return a product, you must contact customer service and notify them of the desired return before sending the package at your expense. Our customer service will guide you through the necessary steps.
The return can only be made if the product has never been opened or used, in impeccable condition as received. Items must be returned in their original packaging with supporting documents. Incomplete, damaged, or soiled items returned by the customer will not be accepted and will be resent at the customer's expense.
Upon return, if the items are in compliance, all fees are refunded except for additional delivery costs chosen by the consumer.
Remember to include in your shipment:
- A copy of the invoice,
- The product or the defective item properly packaged,
- The return form that you have duly filled out and signed.
Article 11. Warranty
In accordance with current legal provisions regarding the conformity of goods to the contract and hidden defects. In the event of non-compliance with a sold product, it can be returned to Sustainable Beauty, which will either take it back, exchange it, or refund it within a maximum period of two years from the delivery of the goods. The company also reimburses all return costs upon presentation of supporting documents.

The buyer can decide to implement the warranty against hidden defects of the sold item within the meaning of Article 1641 of the Civil Code. In this case, the buyer can choose between canceling the sale or reducing the sale price in accordance with Article 1644 of the Civil Code.
Refunds for non-compliant or defective products will be made as soon as possible and no later than fourteen (14) days following the Seller's finding of the lack of conformity or hidden defect. The refund will be made by crediting the customer's bank account or PayPal account.
The Seller's liability cannot be engaged in the event of non-compliance with the legislation of the country to which the products are delivered, which is the customer's responsibility to verify, or in the event of misuse, negligence, or lack of maintenance by the customer, as well as in the case of normal wear and tear of the product, accidents, or force majeure.
The Seller's warranty is, in any case, limited to the replacement or refund of non-compliant or defective products. The replacement of the products does not extend the warranty period.
Products modified, repaired, integrated, or added by the buyer are excluded from warranty. The warranty does not cover products damaged during transport or due to improper use.
Warranty Implementation Procedure:
When acting under the legal conformity warranty, the Buyer:
- Has a period of two years from the delivery of the goods to act;
- Can choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L217-9 of the Consumer Code;
- Is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.
The legal conformity warranty applies independently of any commercial warranty that may cover the product. The Buyer can decide to implement the warranty against hidden defects in the product in accordance with Article 1641 of the Civil Code; in this case, the Buyer can choose between canceling the sale or reducing the sale price in accordance with Article 1644 of the Civil Code.
Article 12. Liability
Sustainable Beauty, in the process of distance selling, is only bound by an obligation of means. Its liability cannot be incurred for damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruption, or other involuntary issues.
In accordance with the provisions of the Consumer Code concerning amicable dispute resolution, Sustainable Beauty adheres to the FEVAD (Federation of E-commerce and Distance Selling) E-commerce Mediator Service, whose contact details are as follows: 60 Rue La Boétie – 75008 Paris – http://www.mediateurfevad.fr. After the consumer's prior written approach to Sustainable Beauty, the Mediator Service can be seized for any consumer dispute that has not been resolved. Article 13. Intellectual Property
All elements of the Site are and remain the intellectual and exclusive property of Sustainable Beauty. The user is not authorized to reproduce, exploit, or use in any way, even partially, elements of the Site, whether in the form of photos, logos, visuals, or text.
Article 14. Personal Data
Sustainable Beauty undertakes to preserve the confidentiality of the information provided by the Buyer, which they may transmit for the use of certain services. Any information concerning the Buyer is subject to the provisions of Law No. 78-17 of January 6, 1978, and European Regulation 2016/679. In this regard, the user has the right to access, modify, and delete information about them. They can make this request at any time via our contact form. Sustainable Beauty processes consumer information in accordance with its Privacy Policy.
Article 15. Applicable Law
These conditions of distance selling are subject to French law.
Annex
Provisions relating to legal guarantees

Article L. 211-5 of the Consumer Code: "To be in conformity with the contract, the good must:
- Be suitable for the usual expected use of a similar good and, where applicable:
- Correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- Present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
- Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter."
Article L. 217-4 of the Consumer Code: "The seller delivers a good in conformity with the contract and is liable for defects of conformity existing at the time of delivery. He is also liable for defects of conformity resulting from packaging, assembly instructions, or installation when it has been charged to him by the contract or has been carried out under his responsibility."
Article L. 217-9 of the Consumer Code: "In case of lack of conformity, the buyer chooses between repairing and replacing the good. However, the seller can choose not to proceed according to the buyer's choice if this choice entails a manifestly disproportionate cost compared to the other method, given the value of the good or the importance of the defect. He must then proceed, unless impossible, according to the method not chosen by the buyer."
Article L. 217-12 of the Consumer Code: "The action resulting from the lack of conformity is prescribed by two years from the delivery of the good."
Article L. 217-16 of the Consumer Code: "When the buyer asks the seller, during the course of the commercial guarantee that was granted to him during the acquisition or repair of a movable property, for a repair covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee that remained to run. This period runs from the buyer's request for intervention or the making available for repair of the property in question, if this making available is subsequent to the request for intervention."
Article 1641 of the Civil Code: "The seller is bound by the warranty on account of hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have given it a lower price, if he had known them."
Article 1643 of the Civil Code: "He is bound by hidden defects, even if he did not know them, unless, in this case, he has stipulated that he will not be obliged to any guarantee."
Article 1644 of the Civil Code: "In the case of Articles 1641 and 1643, the buyer has the choice of returning the item and having the price refunded, or of keeping the item and having part of the price refunded, as will be arbitrated."
Article 1648, paragraph 1, of the Civil Code: "The action resulting from redhibitory defects must be initiated by the purchaser within a period of two years from the discovery of the defect."
